GENERAL SALES TERMS

The offer and sale of products on the website www.ironheal.com and its affiliates are governed by the following general sales terms. The products purchased on the website are sold by Ueal Care s.r.l., with registered office at Piazzale Stazione Marittima, SNC Molo Angioino 80133 (NA) – VAT Number 08327741214

The sales terms are considered known by the Customer at the time of purchase. Therefore, each order implies implicit acceptance. These general terms may be updated or modified at any time by Ueal Care s.r.l., which will update the dedicated pages on the website.

SUBJECT OF THE CONTRACT

The offer and sale of products on the website www.ironheal.com and its affiliates imply the implementation of a distance contract governed by articles 50 et seq. of Legislative Decree 6 September 2005, no. 206 (Consumer Code), as well as Legislative Decree 9 April 2003 no. 70 (so-called E-commerce Law).

ACCEPTANCE OF THE ORDER AND CONCLUSION OF THE SALES CONTRACT

By placing an order, the Customer declares to be aware of and accept these sales terms and the additional information contained on the website. The contract will be considered concluded and binding for both parties only when the Customer is notified of the shipment.

PRODUCTS AND SALES PRICES

All sales prices of products on the website www.ironheal.com and its affiliates include VAT and any other taxes but do not include shipping costs, which are indicated separately. They constitute a public offer in accordance with article 1336 of the Civil Code. It is understood that the image accompanying the product presentation may not be perfectly representative of its characteristics but may differ in color, size, and accessory products present in the figure.

PAYMENT METHODS

At the time of purchase, the Customer can choose to pay via PayPal or Cash on Delivery. For payment via PayPal, the customer will be redirected to the PayPal website to make the payment with any accepted credit card or through their PayPal account. PayPal directly handles the data entered on its website to process the payment. Ueal Care s.r.l. does not collect any data related to the credit card used or access codes for “PayPal” payment. This information is collected directly by PayPal’s systems. In the case of payment by cash on delivery, the customer will have to pay a cost supplement of 5.00 euros (including VAT) for the management of cash on delivery by the express courier. Payment must be made upon delivery, in cash, directly to the courier.

TAX CERTIFICATION AND INVOICE

Invoices for products purchased by private individuals are not issued because they are sales operations not subject to the obligation of tax certification pursuant to Article 22, paragraph 1, no. 1 of DPR 633/1972 and Article 2 of DPR 696/1996. All customers receive an order summary that has the same fiscal and legal value as a traditional receipt.

DELIVERY METHODS AND TIMES

Products are shipped by courier, and delivery times vary depending on the destination, when the order is placed, and the availability of the product. For available goods, delivery to the courier takes place within 5 working days from the date of order confirmation to the customer. Unless unforeseen circumstances, delivery times in the national territory will be 5/7 working days. Upon receipt of the goods, the Customer must verify that the package is perfectly closed, intact, and undamaged. If the customer is not available at the time of delivery, the courier will leave a notice. The next day, a second attempt will be made. If it is not possible to deliver the order even in this case, the Customer must contact the courier as soon as possible to arrange the delivery of the order, within a maximum of 2 working days. To enable delivery without impediments, the Customer is required to enter a mobile phone number in the delivery information, which will be communicated to the courier.

SHIPPING COSTS

A contribution of 10.00€ (plus VAT) is requested for shipping and packaging of the order.

RIGHT OF WITHDRAWAL

In accordance with Articles 64 et seq. of Legislative Decree no. 206/05, the Customer has the right to withdraw without any penalty and without specifying the reason. To exercise this right, the Customer must send an email to info@ironheal.com within 10 working days from receiving the order and a registered letter with return receipt to Ueal Care s.r.l. a Piazzale Stazione Marittima, SNC Molo Angioino 80133 (NA), both containing their information (Name, Surname, Order number, phone, product description, IBAN code, and the account holder where the refund will be made). Ueal Care s.r.l., to facilitate the return process, will communicate a return code to the Customer. Once this communication is received from Ueal Care s.r.l., the Customer must send the product they intend to return at their own expense using a courier of their choice. The returned product must reach Ueal Care s.r.l. no later than 7 (seven) days from the date of sending the return code. Once the returned product is received, Ueal Care s.r.l. will process a bank transfer for the price paid for the product/products (excluding the shipping fee) for which the right of withdrawal was exercised, within 25 working days of receiving the products. The exercise of the right of withdrawal will be ineffective if the returned product is not intact, if it lacks the original packaging, or if essential elements of the product are missing or if the product is damaged. All risks related to the transport of the returned product are the responsibility of the Customer. The right of withdrawal does not apply to perishable products.

PROVISION AND PROCESSING OF PERSONAL DATA

The Customer’s personal data is collected for the purpose of executing the purchase contract and shipping the orders received. This data is processed electronically in compliance with the laws in force and may be exhibited only at the request of the judicial authority or other authorities authorized by law. Personal data will be communicated to individuals delegated to perform the activities necessary for the execution of the contract entered into and will be disclosed exclusively for this purpose. The Customer expressly undertakes to provide Ueal Care s.r.l. with a copy of the identity documents considered necessary for any checks. Failure to comply with the aforementioned request authorizes Ueal Care s.r.l. to immediately terminate the contract for non-compliance. The processing is carried out, also using electronic means, in compliance with the methods set out in Article 11 of Legislative Decree 30 June 2003, no. 196, which guarantees the user’s rights and, in general, protects their fundamental rights, freedoms, and dignity, with particular reference to privacy and personal identity. The processing will take place for a period of time not exceeding that which is strictly necessary to fulfill the above-mentioned purposes. The deletion of personal data is subject to the sending of written communication to Ueal Care s.r.l. The data controller and processor is Ueal Care s.r.l. Piazzale Stazione Marittima, SNC Molo Angioino 80133 (NA).

APPLICABLE LAW AND JURISDICTION

The contract between Ueal Care s.r.l. and the customer is governed by Italian law. Any dispute between the parties regarding this contract will be under the jurisdiction of the Court of Naples.
